Story Submission
I warrant that I am an adult and the sole author of the story, that the story is an original work of authorship, that I did not incorporate into the story any works of authorship owned by any third party. I agree that the State of Vermont may copy, archive, display, distribute, edit and make derivative works of the story I submit, but is not obligated to retain a copy. I understand and agree that by posting my story, others may download or otherwise copy my story, and that the State of Vermont is not responsible in any way for such uses. I further understand that my story may not contain any information concerning any identified individual which is untrue, slanderous, paints that person in a false light or violates that person's right to privacy. I understand that the State of Vermont may, but is not obligated to, change the names of individuals used in the story. I hereby agree to hold harmless the State of Vermont from any claims based upon the publication of the story.
Photographer/Copyright
You must be the sole owner of the copyright of any image submitted. Your submission of the photo and entry form is your guarantee that you are the author and copyright holder of the photo.
Photo Subject Restrictions
Photos must be appropriate for posting on a public government website. Obscene, provocative or otherwise questionable content will not be considered. The State of Vermont retains sole discretion as to what constitutes inappropriate content.
Return of Photos
Photos, regardless of the medium, will not be returned. Please do not send your only copy of a photo.
Ownership/Use Rights
Photographers retain the copyright to their photographs. By submitting photos, photographers agree to have their submitted photograph displayed on the Vermont.gov website without any fee or other form of compensation, and agree that the State of Vermont may display photos in a photo gallery, and may make and retain copies of the photograph for archival purposes. Photos may be credited to the photographer named in the submission form. Submissions may be selected for display or use in other Vermont state government web pages. Submission may also be used by the State of Vermont in any manner for advertising. In the event that ownership of any photograph submitted to the State of Vermont is contested in any manner, the State of Vermont retains the discretion to reject that photograph and discontinue use of the photograph.
Additional Terms and Conditions
The State of Vermont is not responsible for computer system, hardware, software, or program malfunctions or other errors, failures, or delayed computer transactions or network connections that are human or technical in nature. Furthermore, the State of Vermont is not responsible for: (i) lost, misdirected, misplaced, illegible, unintelligible, or incomplete submission or (ii) any act, failure to act, or delay regarding the transmitting or processing of submissions. The State of Vermont reserves the right, in its sole discretion, to cancel or suspend all or any portion of this program without notice if factors beyond the State of Vermont.s control, including technical difficulties, disrupt or corrupt the fair or secure administration or operation of the program. The State of Vermont is entitled to interpret these rules as needed and its decisions are final. The State of Vermont reserves the right to disqualify any entrant that the State of Vermont has reason to believe is not the original work of entrant, or does not otherwise meet the program criteria.
By participating in the program, you agree to release and hold harmless the State of Vermont and its employees, officers, affiliates, agents, and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your participation in this program, including infringement of intellectual property rights. The State of Vermont and its employees, officers, affiliates, agents, and advertising and promotional agencies assume no responsibility or liability for any damages, injuries, claims, causes of actions, or losses of any kind arising in whole or in part from this program.
How to Submit a Photo
Digital photos may be submitted using the online submission form unless the image includes a recognizable person(s). Images that have a recognizable person should be submitted on CD with an original signed model release. Hard copy prints are not accepted.
Submitting Digital Images
Digital images should be submitted using the online entry form. Images should be formatted to 72 dpi, no larger than 600 by 450 pixels and no smaller than 450 by 338 pixels. Panoramic photos are not eligible. Images should be submitted in JPG (at high quality) or TIFF format. File sizes must be less than 350K per image. Images must be in natural color. Digital images will not be returned.
Image Modifications
Minor digital enhancement is permitted, but images that have been significantly modified or appear unnatural will be refused.
Photos displayed on the Vermont.gov website are copyrighted by the photographer. Permission to use the photographs is granted for the following limited uses:
Photos may not be sold or used in any way for profit or commercial purposes, including use in commercial or professional websites or printed materials. Photos may not be used to suggest endorsement by the State of Vermont for a product or service.
Requests for alternate formats or additional uses/rights should be sent to the photographer using the email link provided next to each photo on the Vermont Moments Page. The State of Vermont reserves the right to deny such requests at its discretion. Some requests may be subject to a fee for graphic design services.
